However, a small percentage of Ecstasy clandestine laboratories have been operating in the U.S.

Under Texas Health & Safety Code §§ 481.103, drugs such as Ecstasy are classified as into one Penalty group:

  • Penalty 2

Ecstasy is classified under Penalty group 2 under Texas law. Drugs within this group have a very high chance of being abused.

Potential punishment for Ecstasy offenses differs depending on the type of offense. In Texas, there are three different types of drug offenses – possession, manufacture and delivery.

What is the Punishment Range for Ecstasy Possession under Texas Law?

Possession of Ecstasy (MDMA is a felony in Texas, and the punishment range depends on the amount of drug that was found in one’s possession § 481.116.

  • Less than 1 Gram (POSS CS PG2 <1G), State Jail Felony, punishable between 180 days to 2 years in a state jail facility and a fine up to $10,000.

  • 1 to 4 Grams (POSS CS PG2 1-4G), Third-Degree Felony, punishable between 2 to 10 years in prison and a fine up to $10,000.

  • 4 to 400 Grams (POSS CS PG2 4-400G), Second-Degree Felony punishable between 2 to 20 years in prison and a fine up to $10,000.

  • More than 400 Grams (POSS CS PG2 >400G), Enhanced First-Degree Felony punishable between 5 to 99 years or life in prison and a fine up to $50,000.

What is the Punishment Range for Ecstasy Manufacturing and Delivery?

The manufacture or delivery of Ecstasy (MDMA) is treated more severely, and penalties increase based on the amount of the substance involved § 481.113.

  • Less than 1 Gram (MAN/DEL CS PG2 <1G), State Jail Felony, punishable between 180 days to 2 years in a state jail facility and a fine up to $10,000.

  • 1 to 4 Grams (MAN/DEL CS PG2 1-4G), Second-Degree Felony punishable between 2 to 20 years in prison and a fine up to $10,000.

  • 4 to 400 Grams (MAN/DEL CS PG2 4-400G), First-Degree Felony, punishable between 5 to 99 years or life in prison and a fine up to $10,000.

  • More than 400 Grams (MAN/DEL CS PG2 >400G), Enhanced First-Degree Felony punishable between 10 to 99 years or life in prison and a fine up to $100,000.
